Substitute Resolution No. RS2000-240
A substitute resolution approving Amendment One to the Agreement between the Metropolitan Government and Averitt Properties, Inc., concerning relocation of salt storage facilities.
Whereas, the Metropolitan Council by Ordinance 099-1764 approved a Memorandum of Understanding between the Metropolitan Government and Averitt Properties, Inc.; and
Whereas, said Memorandum of Understanding concerned the relocation of the Metropolitan Government's existing salt storage facilities; and
Whereas, the parties now desire to amend said Memorandum of understanding to provide that Averitt will acquire and dedicate to the Metropolitan Government a site suitable for the relocation of the salt storage facilities; and
Whereas, the amendment tentatively identifies a certain site for the relocated facilities ("the Site"); and
Whereas, it is in the best interests of the Metropolitan Government that the amendment to the Memorandum of Understanding attached hereto Should by approved; and
Whereas, Ordinance 099-1764 provides that amendments to the Memorandum of Understanding require the approval of the Metropolitan Council by resolution.
Now, therefore, be it resolved by the Council of the Metropolitan Government of Nashville and Davidson County:
Section 1. Amendment One to the Memorandum of Understanding approved by Ordinance 099-1764 attached hereto is hereby approved, and the Mayor is authorized to execute said amendment.
Section 2. This substitute resolution shall take effect from and after its passage, the welfare of the Metropolitan Government requiring it.
