SUBSTITUTE RESOLUTION NO. RS 2000-224

A substitute resolution approving an amendment to the agreement between the U.S. Army Corps of Engineers and The Metropolitan Government of Nashville and Davidson County, acting by and through the department of police, concerning the 2000 Plan of Operation for the provision of law enforcement services in the J. Percy Priest Lake and Old Hickory Lake areas and authorizing the mayor to execute same.

Whereas, by Ordinance O93-649 the Metropolitan Council approved a Cooperative Agreement between the U.S. Army Corps of Engineers and The Metropolitan Government of Nashville and Davidson County concerning the provision of law enforcement services by the Metropolitan Government in the J. Percy Priest Lake and Old Hickory Lake areas; and,

Whereas, under the Cooperative Agreement, the Corps and the Metropolitan Government agreed to a Plan of Operation that described the scope and extent of the law enforcement services to be provided by the Metropolitan Government and the compensation to be paid by the Corps for same, all in accordance with the Cooperative Agreement; and,

Whereas, the Cooperative Agreement provides that the Corps and the Metropolitan Government may, at the request of either, renegotiate the Plan of Operation and that the renegotiated Plan of Operation shall, upon written acceptance by both parties, supersede the current Plan of Operation; and,

Whereas, by Ordinance O94-971 the Metropolitan Council provided that any renegotiated Plans of Operation for the Cooperative Agreement shall be approved by the Metropolitan Council by resolution, provided that there are no changes to the terms and conditions of the Cooperative Agreement; and,

Whereas, the Plan of Operation has been renegotiated by the parties;

Now, Therefore, be it resolved by the council of the Metropolitan Government of Nashville and Davidson County:

Section 1. That the amendment to the agreement between the U.S. Army Corps of Engineers and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Police, concerning the 2000 Plan of Operation for the provision of law enforcement services in the J. Percy Priest Lake and Old Hickory Lake areas, a copy of which amendment is attached hereto, is hereby approved and the Metropolitan Mayor is hereby authorized to execute said amendment.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
