SUBSTITUTE RESOLUTION NO. RS2000-166

A resolution approving an interlocal agreement between the State of Tennessee, Department of Finance and Administration and The Metropolitan Government of Nashville and Davidson County, for professional services, including information technology, training and financial and management consulting services.

Whereas, the State of Tennessee, Department of Finance and Administration and The Metropolitan Government of Nashville and Davidson County, have entered into an interlocal agreement for a variety of professional services, including, but not limited to, information technology, training, financial and management consulting services as required by the department of information systems; and

Whereas, the Metropolitan Government of Nashville and Davidson County’s Department of Finance has agreed to certify that each contractor utilized under the agreement is eligible to provide services to the Metropolitan Government in compliance with Title 4 of the Metropolitan Code of Laws; and

Whereas, the Metropolitan Government of Nashville and Davidson County’s Department of Finance has agreed to also certify the availability of funds for each use of the contract to insure that the total compensation for services rendered does not exceed two hundred thousand dollars ($200,000) per year; and

Whereas, Tennessee Code Annotated §12-9-108 provides that the parties’ governing bodies must authorize such agreements.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the interlocal agreement between the State of Tennessee, Department of Finance and Administration and The Metropolitan Government of Nashville and Davidson County for a variety of professional services, including, but not limited to, information technology, training, financial and management consulting services as required by the department of information systems, for a term of five years beginning March 15, 2000 and ending March 14, 2005, which is attached hereto and incorporated herein, is hereby approved.

Section 2. That the Metropolitan Government of Nashville and Davidson County’s Department of Finance shall certify that each contractor utilized under the agreement is eligible to provide services to the Metropolitan Government in compliance with Title 4 of the Metropolitan Code of Laws.

Section 3. That the Metropolitan Government of Nashville and Davidson County’s Department of Finance shall certify the availability of funds for each use of the contract to insure that the total compensation for services rendered does not exceed two hundred thousand dollars ($200,000) per year;

Section 4. That this resolution shall take effect upon its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
