RESOLUTION NO. RS99-91

A resolution accepting $16,421.24 in compromise and settlement of the Metropolitan Government's claim against Sargent Contractors.

Whereas, on March 17, 1999, Sargent Contractors, while performing demolition in the Metropolitan Courthouse, was responsible for damaging a water line that resulted in a leak which caused damage to the computer operations center utilized by the Circuit Court Clerk; and,

Whereas, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable, and recommends that the claim be compromised and settled in an amount not to exceed $16,421.24.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to accept the amount of $16,421.24 in compromise and settlement of its claim against Sargent Contractors.

Section 2: This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
