RESOLUTION NO. RS99-87

A resolution approving a modification to a grant from the federal government through the State of Tennessee, Department of Transportation, to The Metropolitan Government of Nashville and Davidson County acting by and through the Metropolitan Board of Parks and Recreation.

Whereas, pursuant to Ordinance No. 099-1670, the Metropolitan Council approved a grant (the "Grant") from the Federal Government through the State of Tennessee Department of Transportation ("DOT") to The Metropolitan Government of Nashville and Davidson County acting by and through the Metropolitan Board of Parks and Recreation ("Parks"), for use in the design and construction of the Stones River and Mill Creek Greenways (the "Projects"); and

Whereas, DOT and Parks seek to amend the Grant agreement to allow a portion of the available funds to be used for the acquisition of property necessary for the Projects pursuant to the terms set forth in the document attached as Amendment No. 1; and

Whereas, the citizens of Nashville and Davidson County will benefit by amending the grant agreement.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Amendment No. I to Contract No. 98-314 (the Grant) is hereby approved.

Section 2.The Metropolitan Mayor is authorized to execute Amendment No. 1 to the Grant.

Section 3.Any future amendment to the Grant must be approved by resolution of the Metropolitan Council receiving at least 21 affirmative votes.

Section 4. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
