RESOLUTION NO. RS99-36

A resolution approving the settlement of the lawsuit of Karen Helton, Michael Helton and Jared Helton in the amount of $15,000.00 and directing that this amount be paid out of the Self-Insured Liability Fund.

Whereas, plaintiffs Karen Helton and her son, Jared Helton, were injured as a result of an automobile collision with an automobile driven by Vicky Boston Starks on May 5, 1994 on Burkett Road; and,

Whereas, Michael Helton incurred expenses and lost wages as a result of said automobile accident; and,

Whereas, Karen Helton was not at fault in the accident; and

Whereas, the Heltons sued Mrs. Starks and both sets of plaintiffs sued the Metropolitan Government; and,

Whereas, the Heltons and Mrs. Starks have alleged that the accident was caused by defective road conditions on a right-of-way owned by the Metropolitan Government; and,

Whereas, the Metropolitan Department of Law believes that a settlement of Fifteen Thousand ($15,000.00) Dollars, which constitutes 20% of the total settlement, is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid from the Self-Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Metropolitan Department of Law is authorized to compromise and settle the lawsuit of Karan Helton, Michael Helton, and Jared Helton against the Metropolitan Government for the amount of Fifteen Thousand ($15,000.00) Dollars and that said amount should be paid from the Self-Insured Liability Fund.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
