Resolution No. RS99-30

A resolution approving an amendment to a lease agreement by and between The Metropolitan Government of Nashville and Davidson County acting through the Metropolitan Social Services Commission and the Nashville Career Advancement Center with the Corners Associates for property located at 621 Mainstream Drive Nashville, Tennessee.

Whereas, the Metropolitan Government of Nashville and Davidson County acting by and through the Metropolitan Social Services Commission and the Nashville Career Advancement Center ("NCAC") have entered into a Lease Agreement with The Corners Associates for office space located at 621 Mainstream Drive, Nashville, Tennessee on July 17, 1994; and

Whereas, the parties wish to extend the lease term for three (3) years in order to provide services to citizens of Davidson County; and

Whereas, the parties by mutual agreement, wish to amend the Lease Agreement to provide that if any time during the three (3) year period the Metropolitan Social Services Commission desires to vacate their portion of the space upon agreement with NCAC, NCAC will immediately accept responsibility for the area and Metropolitan Social Services shall be released from their obligation; and

Whereas, it is to the benefit of the citizens of the Metropolitan Government of Nashville and Davidson County that this amendment to the Lease Agreement be approved.

Now, therefore, be it resolved by The Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the amendment to the Lease Agreement entered into by and between The Metropolitan Government of Nashville and Davidson County acting by and through the Metropolitan Social Services Commission and NCAC extending the lease term for three (3) years is hereby approved.

Section 2: That the amendment to the Lease Agreement providing that if any time during the three (3) year period the Metropolitan Social Services Commission desires to vacate their portion of the space upon agreement with NCAC, NCAC will immediately accept responsibility for the area and Metropolitan Social Services shall be released from their obligation, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan County Mayor is authorized to execute the same.

Section 3: That this Resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
