Resolution No. RS99-28

A resolution ratifying the acceptance of a proposal to The Metropolitan Government of Nashville and Davidson County from the State of Tennessee, Department of Transportation relating to Project No. CM-STP-112(3); 19046-2211-54, US 41A (SR112) Clarksville Pike intersection improvements at Kings Lane.

Whereas, Ordinance No. O96-199 authorized Contract No. 677 between the State of Tennessee and The Metropolitan Government of Nashville and Davidson County for improvements to US 41A (SR 112) Clarksville Pike at the intersection with Kings Lane under the U.S.C.A., Section 23, Congested Mitigation and Air Quality Improvment Program; and,

Whereas, The Department of Transportation of the State of Tennessee, hereinafter called "Department" has tentatively allocated certain funds for the construction of a project in the area of the Metropolitan Government of Nashville and Davidson County, Tennessee, hereinafter called "Metro" known and described as follows:

improvements at Kings Lane

Whereas, Ordinance No. O96-199 authorizes the Metropolitan County Mayor to execute any and all contracts for said project; and,

Whereas, Ordinance No. O96-199 states that any and all additional contracts between the Department and Metro must be ratified by Resolution by the Metropolitan County Council.

Now therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The proposal submitted by the Department of Transportation of the State of Tennessee to the Metropolitan Government of Nashville and Davidson County to construct in the area of the Metropolitan Government of Nashville and Davidson County Project CM-STP-112(3); 19046-2211-54, US 41A (SR112) Clarksville Pike intersection improvements at Kings Lane, is hereby accepted by the Metropolitan Government. The said proposal is attached hereto and made a part hereof the same as though copied herein.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
