RESOLUTION NO. RS99-22

A resolution requesting the Mayor to take the necessary action to implement appropriate recommendations of the Mason Tillman & Associates disparity study.

WHEREAS, the Metropolitan Government authorized a disparity study which was completed by Mason Tillman & Associates in September 1999; and

WHEREAS, this study indicated that minority and women contractors have been under utilized by the Metropolitan Government, the Metropolitan Transit Authority, the Metropolitan Development and Housing Agency, the Metropolitan Nashville Airport Authority, the Metropolitan Board of Public Education, and the Nashville Electric Service; and

WHEREAS, said study made recommendations to address discriminations against minorities and women and to enhance their participation in governmental contracting; and

WHEREAS, many of the proposed remedies are "race neutral" which are not in violation of federal court decisions which have ruled unconstitutional certain "race conscious" measures; and

WHEREAS, it is fitting and proper that the Mayor take the necessary action to implement the "race neutral" remedies indicated in the disparity study.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVENRMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan County Mayor to take appropriate steps to implement the "race neutral" remedies suggested in the disparity study performed by Mason Tillman & Associates, including but not limited to making prompt payment to contractors and employment of adequate staff and resources to comply with Metropolitan Government’s existing programs to insure opportunities for minorities and women contractors.

SECTION 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the Metropolitan County Mayor.

SECTION 3. That the Metropolitan County Mayor is further requested to inform The Metropolitan Council of the feasibility and/or the actions taken in compliance with the request contained in Section 1 thereof, not later than sixty (60) days after the adoption of this Resolution.

SECTION 4. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
