RESOLUTION NO. RS2003-1568

A resolution approving a fourth amendment to a grant between the State of Tennessee, Department of Correction to The Metropolitan Government of Nashville and Davidson County, acting through the State Trial Courts for the implementation of a supervision and day reporting center.

Whereas, the State of Tennessee, Department of Correction has awarded a grant in an amount not to exceed two million five hundred two thousand eight hundred seventy nine dollars ($2,502,879) to The Metropolitan Government of Nashville and Davidson County, acting through the State Trial Courts for the implementation of a supervision and day reporting center and such grant was approved and accepted by The Metropolitan Council by ordinance (Bill No. BL2001-824); and,

Whereas, the parties, amended the agreement by increasing the grant award to two million five hundred twenty two thousand six hundred thirty eight dollars ($2,522,638) and such amendment was approved by RS2002-924 and further amended by increasing the award to two million five hundred sixty two thousand one hundred fifty six dollars ($2,562,156) and that was approved by RS2002-1191 and further amended by increasing the award from two million five hundred sixty two thousand one hundred fifty six dollars ($2,562,156) to two million five hundred eighty seven thousand six hundred twenty dollars ($2,587,620) and such was approved by RS2003-1382.

Whereas, the parties by mutual agreement, wish to further amend the contract by deleting paragraph C.1 in its entirety and replacing it with a new paragraph that decreases the grant award from two million five hundred eighty seven thousand six hundred twenty dollars ($2,587,620) to two million five hundred thirty five thousand nine hundred sixty two dollars ($2,535,962); and

Whereas, Bill No. BL2001-824 provided that amendments to the Grant may be approved by Resolution by the Metropolitan Council receiving twenty-one affirmative votes; and

Whereas, it is deemed to be in the best interest of The Metropolitan Government that this amendment to the contract be approved.

Now, therefore, be it resolved by The Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the amendment to the Grant by and between the State of Tennessee, Department of Correction and The Metropolitan Government of Nashville and Davidson County, acting through the State Trial Courts, which amendment decreases the grant award from two million five hundred eighty seven thousand six hundred twenty dollars ($2,587,620) to two million five hundred thirty five thousand nine hundred sixty two dollars (2,535, 962), a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the amount of this grant is hereby appropriated to the Department of State Trial Courts in the current fiscal year budget, based on the revenues estimated to be received and any match to be applied.

Section 3. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
