RESOLUTION NO. RS2003-1567

A resolution approving an amendment to a grant between the State of Tennessee, Department of Finance and Administration to The Metropolitan Government of Nashville and Davidson County, acting through the State Trial Courts for the improvement of the criminal justice system.

Whereas, the State of Tennessee, Department of Finance and Administration, has awarded a grant in an amount not to exceed two hundred ninety five thousand dollars ($295,000) for a term of July 1, 2000 through June 30, 2004, to the Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan State Trial Courts for the improvement of the criminal justice system and such grant was approved and accepted by The Metropolitan Council by ordinance (Bill No. BL2000-411); and,

Whereas, the parties, by mutual agreement, wish to amend the contract by deleting paragraph C.1 in its entirety and replacing it with a new paragraph that increases the grant award from two hundred ninety five thousand dollars ($295,000) to three hundred one thousand five hundred twenty six dollars ($301,526); and

Whereas, Bill No. 2000-411 provided that amendments to the Grant may be approved by Resolution by the Metropolitan Council receiving twenty-one affirmative votes;

Whereas, it is deemed to be in the best interest of The Metropolitan Government that this amendment to the contract be approved.

Now, therefore, be it resolved by The Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the amendment to the Grant by and between the State of Tennessee, Department of Finance and Administration and The Metropolitan Government of Nashville and Davidson County, acting through the State Trial Courts, which amendment provides for an increase in the grant award from two hundred ninety five thousand dollars ($295,000) to three hundred one thousand five hundred twenty six dollars ($301,526), to be paid in increments of eighty five thousand ($85,000) for fiscal year 2000-2001; seventy thousand ($70,000) for fiscal year 2001-2002; seventy thousand for fiscal year 2002-2003; and seventy six thousand five hundred twenty six dollars ($76,526) for fiscal year 2003-2004, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the sum of twenty eight thousand three hundred thirty two dollars ($28,333) be provided for the fiscal years 2000-2003 of the grant and twenty five thousand five hundred seven dollars ($235,507) for fiscal year 2003-2004, for the purpose of providing the Metropolitan Government’s matching share for the program.

Section 3. That the amount of this grant is hereby appropriated to the Department of State Trial Courts in the current fiscal year budget, based on the revenues estimated to be received and any match to be applied.

Section 4. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
