RESOLUTION NO. RS2003-1500
A resolution authorizing the Metropolitan Mayor to enter into revised Supplemental
Agreement No. CSX-039988, with CSX Transportation, amending two paragraphs
of the original attached application.
WHEREAS, CSX Transportation owns and maintains railroad tracks in Davidson
County and some surrounding counties; and
WHEREAS, the Metropolitan Department of Water and Sewerage Services entered into a Pipeline Crossing Agreement with CSX Transportation to construct a sewerage line for the Mill Creek Truck Sewer upgrade, Resolution No. RS2001-686 attached as exhibit A; and
WHEREAS, CSX Transportation proposes to amend this application by proposing the changes attached as Exhibit B; and
WHEREAS, that Metropolitan Ordinance No 98-1393 (attached) authorizes all future CSX Transportation license agreements be approved by resolution.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the Metropolitan Mayor, or his designee, is hereby authorized to execute revised Agreement No. CSX-039988, copy attached as Exhibit B.
SECTION 2: That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
