RESOLUTION NO. RS2003-1481
A resolution authorizing the Metropolitan Department of Law to approve a Final Agreement with the United States Department of Justice.
Whereas, Executive Order No. 99-04 established the ADA Task Force to conduct
a comprehensive evaluation of the Metropolitan Government's compliance with Title
II of the Americans With Disabilities Act, (ADA), and the ADA Task Force recommended
certain improvements to bring the Metropolitan Government more fully into compliance
with the ADA; and
Whereas, the Metropolitan Government voluntarily disclosed the status of its
Title II ADA compliance to the United States Department of Justice to preserve
its eligibility for receipt of federal funding; and
Whereas, pursuant to Resolution No. RS2000-280, the Council of the Metropolitan
Government authorized the Metropolitan Department of Law to approve an Interim
Agreement with the United States Department of Justice that ensured the Metropolitan
Government’s continued eligibility to receive federal funds while the Metropolitan
Government completes its ADA efforts; and
Whereas, since that time a Final Agreement with the United States Department
of Justice has been reached that resolves this matter; and
Now, therefore, be it resolved by the Council of The Metropolitan Government
of Nashville and Davidson County:
Section 1. The Metropolitan Department of Law is authorized to enter into a Final
Agreement with the Department of Justice that compromises and settles the claims
of the United States Department of Justice by agreeing to bring its programs,
services, activities, and facilities into compliance with Title II of the ADA.
Section 2: This resolution shall take effect from and after its adoption, the
welfare of the Metropolitan Government of Nashville and Davidson County requiring
it.
