RESOLUTION NO. RS2003-1469


A resolution authorizing the acquisition of real property at 140 North First Street by negotiation for use in a public project for The Metropolitan Government of Nashville and Davidson County (Proposal No. 2003M-005U-09).

WHEREAS, The Metropolitan Government has determined that it is in the best interest of the Department of Water and Sewerage Services to purchase this property; and

WHEREAS, Project NO. 94-SC-5B2, Washington Regulator has been funded under Capital Improvements Budget No. 96SC0021; and

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price, subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council;
and

WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option (ATTACHMENT 1) to acquire real property located in Davidson County being Map No. 082-14, Parcels 59 and 95, and incorporated into this resolution by reference; and

WHEREAS, it is deemed in the best interest of The Metropolitan Government to approve the acquisition of said property.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Director of Public Property is authorized to exercise the option (ATTACHMENT 1) to acquire the property (Map 82-14 Parcel 59 and 95) as shown in Exhibit A and to execute the necessary documents pertaining thereto.

Section 2. That the costs of this acquisition shall be paid from Fund No. 47335.

Section 3. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
