RESOLUTION NO. RS2003-1466

A resolution authorizing the Metropolitan Mayor to enter into Supplemental Agreement No. 500,090, with Nashville and Eastern Railroad Corporation, allowing the Department of Water and Sewerage Services to increase the rental fee for the land lease located at M.P. 1.14, Old Hickory Branch, Hermitage Tennessee.

WHEREAS, Nashville and Eastern Railroad Corporation owns and maintains railroad tracks in Davidson County and some surrounding counties; and

WHEREAS, the Metropolitan Department of Water and Sewerage Services needs to retain their lease in the existing railroad right-of-way located at M.P. 1.14, Old Hickory Branch, Hermitage Tennessee; and,

WHEREAS, that Metropolitan Ordinance No. 98-1364 authorizes all future agreements to be processed by resolution. This work is identified in Metro’s Capital Improvements Budget No. 96SG0005.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor, or his designee, is hereby authorized to execute Agreement No. 500,090, copy attached as Exhibit A.

SECTION 2: That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
