RESOLUTION NO. RS2003-1454
A resolution
calling the Metropolitan Board of Equalization (“the MBOE”)
into regular session convening June 2, 2003 and adjourning June 18, 2003, and
calling the MBOE into special session convening June 19, 2003 to complete any
unfinished business from its regular June 2003 session, to complete the equalization,
and to conduct its administrative duties, as necessary. Said special session
not to continue beyond May 31, 2004.
Whereas, the MBOE shall sit in regular session beginning June 2, 2003 and ending
June 18, 2003; and
Whereas, the MBOE needs to meet in special session beginning June 19, 2003
until the MBOE has heard any appeals timely filed and not heard during its
regular session, completed the equalization, and conducted its administrative
duties, as necessary; and
Whereas, Tenn. Code Ann. § 67-1-404 governs the time which boards
of equalization, including boards of equalization of any metropolitan government
organized and
existing pursuant to Title 7, Chapters 1 through 3, may meet; and
Whereas, Tenn. Code Ann., § 67-1-404(b)(1)(D) authorizes the county
legislative body to fix the number of days the MBOE shall sit in regular
session; and
Whereas, Tenn. Code Ann., § 67-1-404(b)(2) authorizes the county executive,
when the legislative body cannot act, to call the board in special session
at any time if, in the judgment of the county executive, the public welfare
requires it; and
Whereas, the public welfare requires it and the Metropolitan Council can act
to call the MBOE into regular session and special session.
Now therefore, be it resolved by the Council of The Metropolitan Government
of Nashville and Davidson County:
Section 1. The Metropolitan Council hereby calls the MBOE in regular session
beginning on June 2, 2003 and adjourning on June 18, 2003, and further calls
the MBOE in special session convening June 19, 2003 for the purposes of hearing
appeals timely filed for tax year 2003, completing the equalization, and conducting
its administrative duties, as necessary, said special session not to continue
beyond May 31, 2004.
Section 2. The MBOE shall meet in special session at the discretion of its
Chair and/or Vice Chair, if the Chair cannot act.
Section 3. The MBOE is hereby requested to comply with all notice requirements
applicable to special sessions and to notify all MBOE members and interested
parties of the dates on which the MBOE will convene in special session.
Section 4. This Resolution shall take effect from and after its passage, the
welfare of The Metropolitan Government of Nashville and Davidson County requiring
it.
