RESOLUTION NO. RS2003-1427

A resolution authorizing the Metropolitan Department of Law to compromise and settle the lawsuit of Alvin and Ernestine Hawkins against the Metropolitan Government for $22,500 and directing that this amount be paid from the Self-Insured Liability Fund.

Whereas, on February 22, 2002, Alvin and Ernestine Hawkins sustained damage to their property as a result of an air relief valve failure in a sewage force main, maintained by the Metropolitan Department of Water Services; and

Whereas, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid from the Self-Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of Alvin and Ernestine Hawkins for the amount of $22,500 and that said amount should be paid from the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
