RESOLUTION NO. RS2003-1423

A resolution approving the first amendment to an agreement between the Metropolitan Department of Water and Sewerage Services and Tritel Communications, Inc., d/b/a as AT&T Wireless relating to the installation of telecommunications equipment.

Whereas, by adopting Ordinance No. 99-1672, the Metropolitan Council approved an agreement between the Metropolitan Department of Water and Sewerage Services and Tritel Communications, Inc. a Delaware corporation d/b/a AT&T Wireless, hereinafter referred to as Tritel, relating to the installation of telecommunications equipment; and

Whereas, pursuant to the terms of first amendment, attached to this resolution as Exhibit A, both parties seek to amend the provisions of the agreement as set forth therein; and

Whereas, Ordinance No. 99-1672 provides that the agreement may be amended by Resolution of the Metropolitan Council receiving at least 21 affirmative votes; and

Whereas, the citizens of Nashville and Davidson County will benefit by accepting the first amendment to the agreement;

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Director of Public Property of his designee is hereby authorized to execute the attached first Amendment between The Metropolitan Government of Nashville and Davidson County and Tritel.

Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
