RESOLUTION NO. RS2003-1416

A resolution amending Resolution No. 2001-639 the general pay plan for employees of The Metropolitan Government of Nashville and Davidson County; Resolution No. 2001-640 the pay plan for employees of the Metropolitan Departments of Fire and Police; and Resolution No. 2001-641 the pay plan for employees of the Board of Health, by providing for partial pay for employees called to active military duty as a result of the events of September 11, 2001 and for operations Enduring Freedom, Joint Endeavor, Noble Eagle, and any subsequent operations ordered by the President of the United States.

Whereas, employees subject to the general pay plan of The Metropolitan Government of Nashville and Davidson County, the Fire and Police pay plan, and the pay plan for the Board of Health, who are members of the Reserves or National Guard, may be required to serve their country in response to the events of September 11, 2001, and for operations Enduring Freedom, Joint Endeavor, Noble Eagle, and any subsequent operations ordered by the President of the United States, by serving active military duty; and

Whereas, Mayor Bill Purcell has recommended and the Metropolitan Civil Service Commission and the Board of Health acting as a Civil Service Commission agree that it is the desire to support these employees who serve their country by providing pay supplements to them during the extent of their deployment; and

Whereas, pursuant to Resolution No. RS2001-812 the referenced pay plans were amended to provide supplemental pay for employees called to duty as a result of the events of September 11, 2001 subject to the provisions of policies adopted by the Metropolitan Civil Service Commission and the Board of Health acting as a Civil Service Commission; and

Whereas, it is now the desire that the supplemental pay be extended to employees called to serve the United States in other military operations.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The general pay plan for employees of the Metropolitan Government approved in Resolution No. 2001-639; the pay plan for Department of Fire and Police employees approved in Resolution No. 2001-640; and the pay plan for Board of Health employees approved in Resolution No. 2001-641, shall be amended as provided in Exhibit A, to provide for partial pay for employees on active military duty. Exhibit A is incorporated into this resolution as if fully set out herein.

Section 2: If any portion of this resolution shall for any reason be held invalid or unconstitutional, such findings shall not render the remaining portions invalid or unconstitutional, it being the intent of the Metropolitan County Council that the remaining portions of this resolution would have been adopted as if such invalid or unconstitutional portions had been omitted.

Section 3: This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
