RESOLUTION NO. RS2003-1412


A resolution authorizing the Department of Law to compromise and settle the claim of Nashville Fire Department, Emergency Medical Services Division against Tennessee Coordinated Care Network in Liquidation formerly doing business as MedPlus or MedTrust in the amount of $31,656.32, and directing that this amount be paid into the General Fund.


Whereas, on March 5, 2003, Courtney N. Pearre, Special Deputy Liquidator for TCCN, offered to pay for all claims with payable amounts for Dates of Service from May 10, 2000 through February 1, 2001, multiplied by 98.5% which amounts to $31,656.32, or have Metropolitan Government accept payment for claims under the terms of the Liquidation of TCCN which will pay only a pro-rata share of the computed payable amount ; and

Whereas, the Metropolitan Department of Law believes that the settlement of Nashville Fire Department claims for $31,656.32 listed in Section 1 is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid into the General Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims of Nashville Fire Department in the amount of $31,656.32, and that said amount should be paid into the General Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
