RESOLUTION NO. RS2003-1359
A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Todd, Melodie and Edwin Rubenstein against The Metropolitan Government of Nashville and Davidson County in the amount of $65,000.00, and directing that this amount be paid from the Self Insured Liability Account.
Whereas, on March
26, 2000, the Rubenstein’s home at 1431 Finnland Drive
was flooded by a ruptured water line on the street and the Rubensteins experienced
property damage and personal injury as a result; and
Whereas, a lawsuit was filed in the Eight Circuit Court for Davidson County,
Tennessee; and
Whereas, after investigation, the Department of Law believes the settlement
amount of $65,000 is fair and reasonable; and
Whereas, the Department of Law recommends that this case be compromised and
settled and that the amount of $65,000 be paid from the Self Insured Liability
Fund.
Now, therefore, be it resolved by the Council of The Metropolitan Government
of Nashville and Davidson County:
Section 1. The Department of Law is authorized to compromise and settle the
lawsuit of Todd, Melodie and Edwin Rubenstein v. Metropolitan Government, Docket
No. 01C-642, for the sum of $65,000, and directing that this amount be paid
from the Self Insured Liability Account.
Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
