RESOLUTION NO. RS2003-1351

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and adopt legislation that would allow the Metropolitan Government to impose further restrictions regarding uniforms worn by private security guards.

WHEREAS, Chapter 35 of Title 62 of Tennessee Code Annotated regulates the type of uniforms and badges worn by private security guards; and

WHEREAS, this same statutory chapter expressly prohibits local governments from enacting any further regulations of private protective services unless provided otherwise in the chapter; and

WHEREAS, residents of Nashville and Davidson County, especially those residents within the immigrant community, sometimes have difficulty distinguishing between private security guards and sworn law enforcement officers; and

WHEREAS, it is in the best interest of the residents of Nashville and Davidson County that the Metropolitan Government be allowed to impose further restrictions regarding the type and style of uniforms worn by private security guards.


NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:


Section 1. That the Metropolitan County Council hereby goes on record as requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and adopt legislation to allow the Metropolitan Government to impose further restrictions regarding uniforms worn by private security officers within the area of the Metropolitan Government, including but not limited to the type and style of such uniforms, required lettering, and the type of badges and insignia.

Section 2. That the Metropolitan Clerk is directed to send a certified copy of this Resolution to each member of the Davidson County Delegation to the Tennessee General Assembly.

Section 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
