RESOLUTION NO. RS2003-1346

A resolution amending Resolution No. RS2002-920, as amended, by permitting council infrastructure funds designated to be spent in one council district to be combined with funds designated to be spent in another council district for infrastructure projects that would be of benefit to both council districts.


WHEREAS, on January 31, 2002, the Metropolitan County Council adopted Resolution No. RS2002-920, as amended, which appropriated to the Department of Public Works two million dollars ($2,000,000) for infrastructure improvements, with a provision that not more than $57,142.85 be expended in any one council district; and

WHEREAS, Substitute Ordinance No. BL2002-1073, the 2002-2003 budget ordinance adopted by the Metropolitan County Council, appropriated $350,000 to the Reserve for Council Infrastructure Improvement Program, to provide additional funding for the program adopted under Resolution No. RS2002-920, as amended; and

WHEREAS, on August 20, 2002, the Metropolitan County Council adopted Resolution No. RS2002-1125, which appropriated to the Department of Public Works an additional $350,000 for infrastructure improvements, with a provision that not more than $10,000 of the supplemental amount be expended in any one council district; and

WHEREAS, the Council now desires to permit council infrastructure funds designated to be spent in one council district to be combined with funds designated to be spent in another council district for infrastructure projects that would benefit both districts.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Resolution No. RS2002-920, as amended, shall be and the same is hereby amended by adding the following new provision at the end of Section 1:

“Notwithstanding any provision contained herein to the contrary, council infrastructure funds designated to be spent in one council district may be combined with funds designated to be spent in another council district for infrastructure projects that would be of benefit to both districts, provided, however, that not more than the combined total of the council infrastructure funds for the combined districts shall be spent in the council district for which the project or projects are to be constructed.”
Section 2. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
