RESOLUTION NO. RS2003-1332

WHEREAS, in order for the Tennessee Department of Transportation to construct State Project No.19076-2242-14; and

WHEREAS, the estimated cost for the distribution and collection system relocation to the Department of Water and Sewerage Services is $403,638.90 of the total cost; and

WHEREAS, the Tennessee Department of Transportation desires to start construction of said project and has submitted Utility Relocation Contract No. 5928, attached hereto as Exhibit A and made a part of this resolution by reference, for the adjustments or construction of said water & sewer lines and facilities; and

WHEREAS, The Metropolitan Government is authorized by Ordinance No. 2000-391 to enter, by resolution, into Utility Relocation Contract No. 5928 with the Tennessee Department of Transportation, and to enter into an agreement to participate in the Local Government Investment Pool Program upon receipt of executed Contract No. 5928 from the State; and

WHEREAS, this work is identified in METRO’S CAPITAL IMPROVEMENTS BUDGET Nos. 96SG0005 and 93WG0005.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor is hereby authorized to execute Utility Relocation Contract No. 5928 with the Tennessee Department of Transportation, attached hereto as Exhibit A. and made a part of this resolution by reference.

SECTION 2: That the Metropolitan Mayor is hereby authorized to execute any and all agreements necessary to implement the Local Government Investment Pool Program, Exhibit B.

SECTION 3: That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
