RESOLUTION NO. RS2003-1312

A resolution approving an interlocal agreement between the Metropolitan Government, the Electric Power Board of the Metropolitan Government, and the Tennessee Bureau of Investigation for access to 800-MHZ for emergency radio dispatching and response.


Whereas, The Metropolitan Government of Nashville and Davidson County ("Metropolitan Government") and the Electric Power Board of The Metropolitan Government of Nashville and Davidson County ("N.E.S.") jointly own and operate an emergency radio dispatch and response system utilizing 800-MHZ radio frequencies licensed by the Federal Communications Commission ("F.C.C."); and,

Whereas, the Tennessee Bureau of Investigation (T.B.I.) is an agency of the State of Tennessee that exercises duties of law enforcement and protection of the public under T.C.A. § 38-6-101, et seq.; and

Whereas, the T.B.I. wishes to have access to the 800-MHZ radio frequencies licensed to the Metropolitan Government and N.E.S. in order to carry out its statutory responsibilities; and,

Whereas, the Metropolitan Government, N.E.S. and the T.B.I. have agreed upon the terms of an interlocal agreement to allow the T.B.I. interoperability access to the 800-MHZ radio frequencies; and,

Whereas, it is the policy of the Metropolitan Government not to charge any fee for such interoperability access; and,

Whereas, Tennessee Code Annotated, Section 12-9-104, provides that interlocal agreements between governments may be approved by resolution.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Interlocal Agreement by and between The Metropolitan Government of Nashville and Davidson County, the Electric Power Board of The Metropolitan Government of Nashville and Davidson County, and the T.B.I. for interoperability access to the 800-HMZ radio frequencies licensed to the Metropolitan Government and NES solely for public safety purposes, and for a term extending through June 30, 2005, be and the same is hereby approved and the Metropolitan Mayor is hereby authorized to execute said Interlocal Agreement.

Section 2. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
