RESOLUTION NO. RS2002-998

A resolution approving the compromise and settlement of the lawsuit of Adrien Jenkins, next friend of Waymon Jenkins, against The Metropolitan Government of Nashville and Davidson County for the amount of fourteen thousand, two hundred dollars ($14,200) and directing that this amount be paid out of the self-insured liability fund.

WHEREAS, on May 27, 1999, Waymon Jenkins was arrested and was sent to Nashville General Hospital; and,

WHEREAS, on May 28, 1999, Waymon Jenkins was discharged from Nashville General Hospital and admitted to the Criminal Justice Center where he continued to complain of great physical pain; and,

WHEREAS, on May 29 and May 30, 1999, Waymon Jenkins was transported to the Medical Clinic run by Prison Health Services for diagnosis and treatment; and,

WHEREAS, on the early morning of June 1, 1999 Waymon Jenkins died; and,

WHEREAS, Ms. Adrien Jenkins, the wife of Waymon Jenkins has filed suit alleging that her husband was not given appropriate medical care; and,

WHEREAS, the Department of Law believes that the settlement set forth in Section 1 below is fair and reasonable, and recommends that this lawsuit be compromised and settled as to all parties and that said amount be paid out of the Self-Insured Liability Fund.

Now, therefore, be it resolved by the council of the Metropolitan Government of Nashville and Davidson County:

Section 1. That the Metropolitan Department of Law is authorized to compromise and settle the lawsuit of Adrien Jenkins against the Metropolitan Government for the amount of fourteen thousand, two hundred dollars ($14,200) and that said amount should be paid from the Self-Insured Liability Fund.

Section 2. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
