RESOLUTION NO. RS2002-951

A resolution requesting the Metropolitan Planning Commission to prepare a text change to restrict the location of group homes to the extent legally permissible.

WHEREAS, certain residential properties may be utilized as group homes by non-related persons according to federal and state law without compliance with local zoning laws; and

WHEREAS, although such group homes may serve a legitimate purpose, it is appropriate to regulate such facilities so as not to destroy neighborhoods.

NOW, THEREFORE, BE IT RESOLVED BY THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Planning Commission to prepare a text change to restrict the location of group homes to the extent legally permissible.

SECTION 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the Executive Director and each member of the Metropolitan Planning Commission.

SECTION 3. That the Executive Director and members of the Metropolitan Planning Commission are further requested to inform the Metropolitan Council of the feasibility and/or the actions taken in compliance with the request contained in Section 1 hereof, not later than sixty (60) days after the adoption of this Resolution.

SECTION 4. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
