RESOLUTION NO. RS2002-1294


A resolution to amend Ordinance No. 2002-1141 to add two additional parcels in connection with Grizzard Manor Grinder Pump Installation, Metro Water Services Project 01-SG-86A, Map 12, Parcel 59 and 60 (Proposal No. 2002M-107G-02).

WHEREAS, Section 2.01 of the Charter of the Metrpolitan Government of Nashville and Davidson County grants government the taking and appropriation of real property within the area of the Metroplitan Government for any public purpose when the public convenience requires it; and

WHEREAS, it is in the public interest that utility easements be acquired to permit the construction of grinder pump installation to provide sanitary sewers within the area designated for Project 01-SG-86A; and

WHEREAS, Project No. 01-SG-86A, Grizzard Manor Grinder Pump Installation funded under Capital Improvements Budget No. 01SG0001; and

WHEREAS, the Metropolitan Planning Commission of Nashville and Davidson County has approved this acquisition on October 29, 2002, Proposal Number 202M-107G-02.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Director of Public Property, or his designee, is hereby authorized to acquire by negotiation or condemnation for the purpose of constructing, maintaining and operating sanitary sewers, storm sewers and/or appurtenances; the initial project to be constructed in the easements described hereinafter as Project No. 01-SG-86A, Grizzard Manor Grinder Pump Installation, Map 12, Parcel 59 and 60. A list of property addresses and map and parcel numbers is attached to this document. All necessary and incidental costs of this easement acquistion shall be paid from funds authorized from the Water and Sewer Extension and Replacement Fund.

SECTION 2. The Metropolitan Government acting through the Department of Water and Sewerage Services is authorized to enter into financing agreements with the property owners being served by this project.

SECTION 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
