RESOLUTION NO. RS2002-1290


A resolution approving an amendment to a grant between the State of Tennessee, Department of Transportation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Historical Commission for the Hermitage Replanting Project.

Whereas, the State of Tennessee, Department of Transportation has awarded a grant in an amount not to exceed two hundred fifty thousand dollars ($250,000) to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Historical Commission for the Hermitage Replanting Project and such grant was approved and accepted by The Metropolitan Council by ordinance (Bill No. BL2001-756); and,

Whereas, the parties, by mutual agreement, wish to amend the contract by amending paragraphs 3 and 4 of Page 1 of Contract Number 99-242 to increase the grant award from two hundred fifty thousand dollars ($250,000) to four hundred ninety thousand dollars ($490,000); and

Whereas, The Hermitage has agreed to provide one hundred twenty two thousand five hundred dollars ($122,500) as the required matching funds for the replanting project; and

Whereas, Bill No. BL2001-756 provided that amendments to the Grant may be approved by Resolution by the Metropolitan Council receiving twenty-one affirmative votes;

Whereas, it is deemed to be in the best interest of The Metropolitan Government that this amendment to the contract be approved.

Now, therefore, be it resolved by The Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the amendment to the Grant by and between the State of Tennessee, Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Historical Commission, which amendment provides for an increase in the grant award from two hundred fifty thousand dollars ($250,000) to four hundred ninety thousand dollars ($490,000), a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
