RESOLUTION NO. RS2002-1289


A resolution approving an amendment to a contract between The Metropolitan Government of Nashville and Davidson County and The Hermitage for the implementation of an activity of the Surface Transportation Program, administered by the State of Tennessee, Department of Transportation for the replanting of trees at The Hermitage.

Whereas, The Hermitage wishes to participate in the implementation of the Surface Transportation Program funded by the State of Tennessee for the replanting of trees on the grounds of the Hermitage lost by tornado damage; and

Whereas, the State of Tennessee requires that a governmental entity accept and distribute the funds for this program; and

Whereas, the State of Tennessee, Department of Transportation and The Metropolitan Government of Nashville and Davidson County have entered into a grant agreement for acceptance of said funds to be distributed to the Hermitage for the tree replanting project and such grant was approved and accepted by The Metropolitan Council by ordinance (Bill No. BL2001-756); and

Whereas, the State of Tennessee, Department of Transportation has increased the grant award from two hundred fifty thousand dollars ($250,000) to four hundred ninety thousand dollars ($490,000);

Whereas, The Metropolitan Government of Nashville and Davidson County and the Hermitage have negotiated an agreement for the receipt of these funds and implementation of the tree replanting project in accordance with the terms set forth by the State of Tennessee, Department of Transportation and such contract was approved and accepted by The Metropolitan Council by ordinance (Bill No. BL2001-757); and

Whereas, the parties, by mutual agreement, wish to amend the contract by amending paragraph 5a to increase the grant award from two hundred fifty thousand dollars ($250,000) to four hundred ninety thousand dollars ($490,000); and

Whereas, The Hermitage has agreed to provide one hundred twenty two thousand five hundred dollars ($122,500) as the required matching funds for the replanting project; and

Whereas, Bill No. BL2001-757 provided that amendments to the contract may be approved by Resolution by the Metropolitan Council receiving twenty-one affirmative votes;

Whereas, it is deemed to be in the best interest of The Metropolitan Government that this amendment to the contract be approved.

Now, therefore, be it resolved by The Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the amendment to the contract by and between The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Historical Commission and the Hermitage for the replanting of trees lost by tornado damage and in accordance with the terms set forth by the State of Tennessee, Department of Transportation which amendment provides for an increase in the grant award from two hundred fifty thousand dollars ($250,000) to four hundred ninety thousand dollars ($490,000), a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
