RESOLUTION NO. RS2002-1286


A resolution authorizing the Metropolitan Mayor to enter into Sewer Line Agreement No. 500,443 and 500,444, with Nashville and Eastern Railroad Corporation, allowing the Department of Water and Sewerage Services to construct and maintain sewer lines in the railroad right-of-way from Elm Hill Pike to Windermere Drive for the Briley Parkway widening project, Project No. 01-SG-92.

WHEREAS, Nashville and Eastern Railroad Corporation owns and maintains railroad tracks in Davidson County and some surrounding counties; and

WHEREAS, the Metropolitan Department of Water and Sewerage Services needs to construct a sewer line in the existing railroad right-of-way located at Elm Hill Pike to Windermere Drive for the Tennessee Department of Transportation Briley Parkway widening project; and

WHEREAS, Nashville and Eastern Railroad Corporation proposes to permit the Metropolitan Department of Water and Sewerage Services to construct sewer lines in the railroad right-of-way in connection with Project No. 01-SG-92 pursuant to the terms of the agreements attached to this Resolution as Exhibit A and B; and

WHEREAS, that Metropolitan Ordinance No. 98-1364 authorizes all future agreements to be processed by resolution.

WHEREAS, this work is identified in METRO’S CAPITAL IMPROVEMENTS BUDGET No. 96SG0005.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor, or his designee, is hereby authorized to execute Agreement Nos. 500,443 and 500,444, copy attached as Exhibit A and B.

SECTION 2: That this Ordinance shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

RESOLUTION NO. RS2002-1286


Mr. President:

I move to amend Resolution No. RS2002-1286 by deleting the word “Ordinance”,

wherein it appears in Section 2 of the Resolution, and substituting in lieu thereof the word

“Resolution”.
