RESOLUTION NO. RS2002-1285

A resolution approving an amendment to an agreement between the Metropolitan Department of Water and Sewerage Services and Powertel/Memphis, Inc. relating to the installation of telecommunications equipment.

Whereas, by adopting Ordinance No. 098-1429, the Metropolitan Council approved an agreement between the Metropolitan Department of Water and Sewerage Services and Powertel/Memphis, Inc. relating to the installation of telecommunications equipment; and

Whereas, pursuant to the terms of the amendment (the “Amendment”) attached to this ordinance as Exhibit A both parties seek to amend the provisions of the agreement as set forth therein; and

Whereas, Ordinance No. O98-1429 provides that the agreement may be amended by Resolution of the Metropolitan Council receiving at least 21 affirmative votes; and

Whereas, the citizens of Nashville and Davidson County will benefit by accepting the Amendment to the agreement;

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Metropolitan Mayor is hereby authorized to execute the attached Amendment between The Metropolitan Government of Nashville and Davidson County and Powertel/Memphis, Inc.

Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
