RESOLUTION NO. RS2002-1277


A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Children’s World Learning Center and Coit Services Inc. against The Metropolitan Government of Nashville and Davidson County for $85,000 and directing that this amount be paid from the Self-Insured Liability Fund.


Whereas, on July 8, 2002, Children’s World Learning Center sustained water damage to its building as a result of a sewage back up caused by blockage in the sewer segment maintained by the Metropolitan Department of Water Services. Coit Services Inc. was employed by the Metropolitan Government to clean and repair damage to the building; and

Whereas, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid from the Self-Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of Children’s World Learning Center and Coit Services Inc. for the total amount of $85,000 and that said amount should be paid from the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
