RESOLUTION NO. RS2002-1246

A resolution approving an amendment to an agreement between the Metropolitan Department of Water and Sewerage Services and Sprint Spectrum, L.P.

Whereas, by adopting Ordinance No. S099-1561, the Metropolitan Council approved an agreement dated May 18, 1999, between the Metropolitan Department of Water and Sewerage Services and Sprint Spectrum L.P.; and

Whereas, pursuant to the terms of the document (the “Amendment”) attached to this ordinance as Exhibit A, both parties seek to amend the provisions of the agreement as set forth therein; and

Whereas, Ordinance No. SO99-1561 provides that the agreement may be amended by Resolution of the Metropolitan Council receiving at least 21 affirmative votes; and

Whereas, the citizens of Nashville and Davidson County will benefit by accepting the Amendment to the agreement;

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Metropolitan Mayor is hereby authorized to execute the attached Amendment between The Metropolitan Government of Nashville and Davidson County and Sprint Spectrum, L.P.

Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
