RESOLUTION NO. RS2002-1219


A resolution approving a lease agreement between The Metropolitan Government of Nashville and Davidson County on behalf of the Department of Law and the Office Ware for the lease of a copier.

Whereas, the State of Tennessee has entered into a lease agreement with Office Ware for copiers for various state departments (Contract No. 4027057); and,

Whereas, Metropolitan Code of Laws, §4.12.090(B) provides that the purchasing agent may make purchases using the provisions of contracts entered into by the State Department of General Services in compliance with Tennessee Code Annotated §12-3-1001(c); and

Whereas, the Department of Law is in need of a copier; and

Whereas, Metropolitan Code of Laws Section 5.04.020, which applies to all departments, boards, commissions and agencies, provides that all leases for equipment shall be approved by resolution of the Metropolitan Council if the annual expenditure for said lease exceeds five thousand dollars ($5,000) per year; and,

Whereas, the annual expenditure to lease the selected copier exceeds five thousand dollars ($5,000) per year; and,

Whereas, it is deemed to be in the best interest of the Metropolitan Government to approve said contract.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the lease of a copier, (Model No. Lanier 5705 Digital Copier) by The Metropolitan Government of Nashville and Davidson County on behalf of the Department of Law, using the contract between the State of Tennessee and Office Ware (Contract No. 4027507), a copy which is attached hereto and incorporated herein, at the annual lease cost of not less than twelve thousand nine hundred fifty four dollars ($12,954) is hereby approved.

Section 2. That this resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
