RESOLUTION NO. RS2002-1163


A resolution approving the compromise and settlement of the lawsuit of Mario Hambrick against Police Detective Billy Brewer in an amount not to exceed $6,500, and directing that this amount be paid out of the Judgment and Losses Fund.

WHEREAS, on June 8, 1999, Mario Hambrick was arrested by Police Detective Billy Brewer, acting in his course and scope of his employment, upon a complaint that Mario Hambrick was representing himself as a law enforcement agent; and

WHEREAS, Mario Hambrick was subsequently found not guilty of the criminal charges after having suffered the loss of his livelihood as a security guard for a period of months; and

WHEREAS, a settlement of this matter was deemed to be in the best interest of the Metropolitan Government and Detective Brewer.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Department of Law is authorized to compromise and settle the lawsuit of Mario Hambrick against Detective Billy Brewer for the amount of Six Thousand Five Hundred Dollars ($6,500) and that said amount should be paid from the Judgment and Losses Fund.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
