RESOLUTION NO. RS2002-1161

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Benjamin Fuson against The Metropolitan Government of Nashville and Davidson County for $25,400.69 and directing that this amount be paid from the Self-Insured Liability Fund.

Whereas, on November 30, 2001, Benjamin Fuson’s residence sustained property damage as a result of a sewage back up caused by a blockage in the sewer line maintained by the Metropolitan Department of Water Services; and

Whereas, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid from the Self-Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of Benjamin Fuson in the amount of $25,400.69 and that said amount should be paid from the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
