RESOLUTION NO. RS2002-1158
A resolution authorizing the Metropolitan Mayor to enter into Sewer Line Agreement No. CSX-043721, with CSX Transportation, allowing the Department of Water and Sewerage Services to construct and maintain sewer lines in the railroad right-of-way located at the intersection of Carney Street, Second Avenue South, and Ensley Boulevard, Project No. 02-SG-41.
WHEREAS, CSX Transportation owns and maintains railroad tracks in Davidson County and some surrounding counties; and
WHEREAS, the Metropolitan Department of Water and Sewerage Services needs to construct a sewer line in the existing railroad right-of-way located at the intersection of Carney Street, Second Avenue South, and Ensley Boulevard; and
WHEREAS, CSX Transportation proposes to permit the Metropolitan Department of Water and Sewerage Services to construct sewer lines in the railroad right-of-way in connection with Project No. 02-SG-41 pursuant to the terms of the agreement attached to this Resolution as Exhibit A; and
WHEREAS, that Metropolitan Ordinance No 98-1393 authorizes all future CSX Transportation license agreements by approved by resolution.
WHEREAS, this work is identified in METRO’S CAPITAL IMPROVEMENTS BUDGET No. 01SG0001.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the Metropolitan Mayor, or his designee, is hereby authorized to execute Agreement No. CSX-043721, copy attached as Exhibit A.
SECTION 2: That this Ordinance shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
