RESOLUTON NO. RS2002-1109

A resolution approving an amendment to a grant between the State of Tennessee, Department of Transportation to The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Police Department, for the Governor’s Highway Safety Program.

Whereas, the State of Tennessee, Department of Transportation, has awarded Grant No. 154AL-02-14 in an amount not to exceed one million two hundred twenty one thousand two hundred seventy four dollars ($1,221,274) to The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Police Department for the Governor’s Highway Safety Program, which is designed to reduce traffic related crash fatalities with special emphasis on overtime enforcement involving alcohol or drug impaired drivers and such grant was approved and accepted by The Metropolitan Council by ordinance (Bill No. BL2002-1026); and,

Whereas, the parties, by mutual agreement, wish to amend the contract by deleting paragraph B.2 in its entirety and replacing it with a new paragraph that provides for extensions of the grant term for a total contract term of no more than three years; and

Whereas, the parties, by mutual agreement, wish to amend Attachment 2, Grant Budget to the contract by changing the rate of reimbursement for travel from $1.96 per mile to $.32 per mile; and

Whereas, Bill No. BL2002-1026 provided that amendments to the Grant may be approved by Resolution by the Metropolitan Council receiving twenty-one affirmative votes;

Whereas, it is deemed to be in the best interest of The Metropolitan Government that this amendment to the contract be approved.

Now, therefore, be it resolved by The Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the amendment to the Grant by and between the State of Tennessee, Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Police Department for the Governor’s Highway Safety Program, which amendment provides for extensions of the grant term for a total contract term of no more than three years and amending Attachment 2, Grant Budget to the contract by changing the rate of reimbursement for travel from $1.96 per mile to $.32 per mile, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
RESOLUTION NO. RS2002-1109

Mr. President:

I move to amend Resolution No. RS2002-1109 by deleting the phrase “$1.96 per mile”, wherein it appears both in the third recital clause and in Section 1, and substituting in lieu thereof the phrase “1.96 per hour”.
