RESOLUTON NO. RS2002-1105

A resolution authorizing the Metropolitan Government to enter into an agreement with CSX Transportation, Inc., for the purpose of installing a wireline across property located at Valuation Station 438+05, Milepost 0BA-189.25, Nashville Terminal Subdivision


Whereas, pursuant to Resolutions R94-1221 and R99-1590, the Metropolitan Government of Nashville and Davidson County (“the Metropolitan Government”) entered into certain contracts with the State of Tennessee for purposes of implementing Project CM/M-9312(29), Signal System Upgrade for the Metropolitan Nashville Area; and

Whereas, to implement said Signal System Upgrade fully it is necessary that the Metropolitan Government construct and maintain a wireline above premises owned by CSX Transportation, Inc., a Virginia corporation (“CSX”) to control and coordinate operation of traffic signals on Nolensville Road and Thompson Lane; and

Whereas, it is in the best interests of the Metropolitan Government to execute the agreement with CSX attached hereto; and

Whereas, Ordinance O76-242 authorizes approval of all agreements necessary to implement the Federal-Aid Urban System by resolution of the Metropolitan Council; and

Whereas, the attached agreement between the Metropolitan Government and CSX is necessary for implementation of the Federal-Aid Urban System, under which funding for the Signal System Upgrade is provided,

Now, therefore, be it resolved by the Council of the Metropolitan Government of Nashville and Davidson County:

Section 1. The agreement with CSX Transportation, Inc., attached hereto is approved, and the Metropolitan Mayor is authorized to execute said agreement.

Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
