RESOLUTION NO. RS2002-1069

A resolution calling the Metropolitan Board of Equalization in special session beginning after The Board adjourns its June 2002 regular session, until the Board has heard appeals on pro-rated assessments, completed unfinished business from their regular session in June 2002, heard any and all back assessments and/or reassessments allowed by law, and any other appeals timely filed, not to continue beyond May 31, 2003.

WHEREAS, the Metropolitan Board of Equalization needs to meet in special session beginning June 26, 2002 until the Board has heard appeals on pro-rated assessments, completed unfinished business from their regular session in June 2002, heard any and all back assessments and/or reassessments allowed by law, and any other appeals timely filed; and

WHEREAS, Tenn. Code Ann. § 67-1-404 governs the time which boards of equalization, including boards of equalization of any metropolitan government organized and existing pursuant to Title 7, Chapters 1 through 3, may meet; and

WHEREAS, Tenn. Code Ann., § 67-1-404(b)(2) authorizes the county executive, when the legislative body cannot act, to call the board in special session at any time if, in the judgment of the county executive, the public welfare requires it; and

WHEREAS, the public welfare requires it and the Metropolitan Council can act to call the Board in special session.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Council hereby calls the Metropolitan Board of Equalization in special session beginning immediately after the Board adjourns its June 2002 regular session, and ending when the Board has heard appeals on 2002 pro-rated assessments, completed unfinished business from their June 2002 regular session, heard any and all back assessments and/or reassessments allowed by law, and any other appeals timely filed, said special session not to continue beyond May 31, 2003.

Section 2. The Metropolitan Board of Equalization shall convene in special session at the discretion of the Board's Chair and/or the Board's Vice Chair, if the Chair cannot act.

Section 3. The Board is hereby requested to comply with all notice requirements applicable to special sessions and to notify all Board members and interested parties of the dates on which the Board will convene in special session.

Section 4. This Resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
