RESOLUTION NO. RS2002-1068

A resolution setting a public hearing on the development of low-rent scattered site housing.

WHEREAS, Resolution No. R92-288 was adopted by the Metropolitan Council on June 16, 1992 authorizing the Metropolitan Mayor to execute a Cooperation Agreement with the Metropolitan Development and Housing Agency in support of up to two hundred (200) units of low-rent housing; and

WHEREAS, the Metropolitan Development and Housing Agency is planning the development of nineteen (19) units of low-rent housing to be built primarily as duplexes on vacant lots owned by the Agency in the vicinity of the Preston Taylor Hope VI Development Project.

WHEREAS, the Metropolitan Development and Housing Agency will submit the proposed building sites and development objectives of the project to the Metropolitan Council for its approval; and

WHEREAS, Section 13-20-104, Tennessee Code Annotated, requires a public hearing on the project prior to final approval being given by the Metropolitan Council; and

WHEREAS, a legal notice stating the date, time and place of said public hearing must be published in the newspaper of general circulation in the locality where the project is situated.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That, at the meeting of the Metropolitan Council to be held on Tuesday, July 16, 2002, at 7:30 p.m. in the Metropolitan Council Chamber on the second floor of the Courthouse, the Council shall conduct a public hearing relative to the development of replacement scattered site public housing units authorized by Resolution No. R-92-288 in the manner required by law, at which hearing any person or organization desiring to be heard regarding the development of these housing units will be afforded such an opportunity.

Section 2. That the Metropolitan Clerk be and is hereby directed to have published in the Tennessean, being the newspaper of general circulation in Nashville, Tennessee, in the issues of July 1, 8, and 15, 2002, a legal notice declaring a public hearing will be held at the time and place aforesaid in the manner prescribed by law.

Section 3. That this Resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
