A resolution authorizing The Metropolitan Government of Nashville and Davidson County to enter into an agreement with the U.S. Army Corps of Engineers concerning construction and maintenance of certain drainage culverts and concrete headwalls on Smith Springs Road, J. Percy Priest Tract No.1031 (Proposal No. 2002M-043U-13).

Whereas, The Metropolitan Government of Nashville and Davidson County proposes to maintain certain drainage facilities, specific alley drainage culverts and concrete headwalls, on Smith Springs Road, J. Percy Priest Tract #1031; and,

Whereas, the location of this improvement requires an easement on property held by the U.S. Army Corps of Engineers; and,

Whereas, the attached agreement conveys the necessary easement from the Corps of Engineers to the Metropolitan Government, in consideration of the agreement to operate and maintain said facilites; and,

Whereas, TCA section 12-9-101 et. Seq. authorizes the approval of such agreements by resolution of the Metropolitan Council,

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The attached agreement with the U.S. Army Corps of Engineers is approved; and the Metropolitan Mayor is authorized to execute said agreement.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
