RESOLUTION NO. RS2002-1037

A resolution setting a public hearing on the continuation of the Central Business Improvement District.

WHEREAS, pursuant to the Central Business Improvement District Act of 1990, property owners in a confined area within downtown Nashville representing at least 51% of the real property owners and at least 67% of the assessed value of all real property within that area, presented petitions to the Metropolitan Government of Nashville and Davidson County in 1998 requesting creation of a Central Business Improvement District (the "District") for downtown Nashville; and

WHEREAS, the Metro Council adopted Ordinance No. BL098-1037 to create the District and set a dissolution date of January 1, 2003 and further required that the District shall not be dissolved if a petition satisfying the requirements of the Central Business Improvement Act is filed requesting that the District be continued; and

WHEREAS, the Nashville District Management Corporation desires to continue the operations of the Central Business Improvement District for a term to begin January 1, 2003 and end on December 31, 2007 and has filed a petition with the office of the clerk to that effect, as required by The Central Business Improvement Act, Tennessee Code Annotated section 7-84-511; and

WHEREAS, section 7-84-513, Tennessee Code Annotated, requires a public hearing to be held not less than thirty days or more than forty-five days following the filing of the petition; and after the second reading of the ordinance that is before Council that authorizes the establishment/ continuation of the District; and

WHEREAS, a notice of the public hearing must be published in a local newspaper once a week for three consecutive weeks with a hearing to be held at least seven days following the publication of the third notice.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That, at the meeting of the Metropolitan Council to be held on June 4, 2002 in the Metropolitan Council Chamber on the second floor of the Courthouse, the Council shall conduct a public hearing relative to approval of the continuation of the Central Business Improvement District in the manner required by law, at which hearing any person or organization desiring to be heard on the continuation of said District will be afforded such an opportunity.

Section 2. That the Metropolitan Clerk be and is hereby directed to have published in The Tennessean being a newspaper of general circulation in Nashville, Tennessee, legal notice declaring a public hearing will be held at the time and place aforesaid in the manner prescribed by law.

Section 3. That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
