RESOLUTION NO. RS2002-1010
A resolution approving the assignment of certain rights and interests of the Cumberland Science Museum as Lessee of Metropolitan Government property.
Whereas, pursuant to an
agreement (the "Lease") dated July 1, 1967, the Metropolitan Government
leased a certain parcel of property (the "Property") to the Cumberland
Museum's ("CSM") predecessor in interest; and
Whereas, the Lease provides
that CSM must obtain the consent of the Metropolitan Board of Parks and Recreation
and the Metropolitan Council to the assignment of any rights, interests or obligations
arising under the Lease; and
Whereas, CSM desires to
construct certain improvements (the "Project") on the Property and
in order to obtain financing for the Project must assign (the "Assignment")
certain of its rights and interests under the Lease; and
Whereas, the Metropolitan
Board of Parks and Recreation has consented to the Assignment; and
Whereas, pursuant to the
terms of the document attached as Exhibit A and incorporated into this resolution,
CSM seeks the consent of the Metropolitan Council to the Assignment; and
Whereas, the citizens of
Nashville and Davidson County will benefit from consenting to the Assignment.
Now, therefore, be it resolved
by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. The proposed
Assignment (Exhibit A) is hereby approved for execution and delivery by the
Metropolitan Mayor.
Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
