RESOLUTION NO. RS2002-1000
A resolution setting a public hearing for a proposed amendment to the Capitol Mall Redevelopment Plan.
WHEREAS, a Capitol Mall Redevelopment Plan consisting of a text, exhibit, and maps currently exists as previously approved by Ordinance Number 82-845, and subsequently amended by the adoption of Ordinance Nos. 87-1695, 91-1567, 93-774, 97-755, and 98-1187; and
WHEREAS, the Metropolitan Development and Housing Agency desires to amend the Capitol Mall Redevelopment Plan; and
WHEREAS, the project is to be undertaken by the Metropolitan Development and Housing Agency in accordance with and in furtherance of the objectives of Tennessee Code Annotated, Sections 13-20-201 through 216; and
WHEREAS, Tennessee Code Annotated, section 13-20-203, requires a public hearing on the amendment of any redevelopment plan prior to final approval being given by the Metropolitan Council; and
WHEREAS, The proposed amendment will be referred by the Metropolitan Development and Housing Agency to the Metropolitan Council for its review and approval; and
WHEREAS, a legal notice stating the date, time and place of said public hearing must be published in each newspaper of general circulation in the locality where the project is situated.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY TENNESSEE:
Section 1. That at the meeting of the Metropolitan Council to be held on Tuesday, May 21, 2002, at 7:00 p.m. in the Metropolitan Council Chamber on the second floor of the Courthouse, the Council shall conduct a public hearing relative to amending the Capitol Mall Redevelopment Plan in the manner required by law, at which hearing any person or organization desiring to be heard regarding the proposed plan will be afforded such an opportunity.
Section 2. That the Metropolitan Clerk is hereby directed to have published in The Tennessean, being the daily newspaper of general circulation in Nashville, Tennessee, in the issues of May 6, May 13 and May 20, 2002, a legal notice declaring a public hearing will be held at the time and place aforesaid in the manner prescribed by law after approval of said legal notice by the Metropolitan Attorney.
Section 3. That the Metropolitan Development and Housing Agency be and is hereby authorized and directed to give written notice of the public hearing to at least one of the owners or at least one of the occupants of each parcel of property within the area affected by the proposed plan, as required by law.
Section 4. That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
