RESOLUTION NO. RS2001-874

A resolution electing three members to the Board of Directors of the Industrial Development Board of the Metropolitan Government of Nashville and Davidson County.

WHEREAS, the Metropolitan County Council has, pursuant to Chapter 53 of Title 7 of the Tennessee Code Annotated, as amended, duly authorized and approved the establishment of The Industrial Development Board of the Metropolitan Government of Nashville and Davidson County; and

WHEREAS, T.C. A., § 7-53-301, as amended, provides that all members of the Board of Directors shall be elected by the governing body of the Metropolitan Government of Nashville and Davidson County; and

WHEREAS, the terms of three members of said Board of Directors have expired, and it is necessary that these positions be filled by election of the Metropolitan County Council; and

WHEREAS, Aubrey Gregory has been nominated by Phil Ponder; and

WHEREAS, Grace Fairbanks has been nominated by Lynn Williams; and

WHEREAS, Odie Jones has been nominated by Tony Derryberry; and

WHEREAS, Timothy Ayers has been nominated by Ludye Wallace; and

WHEREAS, Hal Rosson has been nominated by Jim Shulman; and

WHEREAS, Sam Latham has been nominated by Brenda Gilmore; and

WHEREAS, Odie Jones, Timothy Ayers and Sam Latham each withdrew their names from nomination prior to the election; and

WHEREAS, an election has been conducted pursuant to the Rules of Procedure of the Metropolitan County Council of the Metropolitan Government of Nashville and Davidson County on December 4, 2001, resulting in the election of Grace Fairbanks, Aubrey Gregory, and Hal Rosson to said positions.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. Grace Fairbanks, who is an elector of and taxpayer in the Metropolitan Government of Nashville and Davidson County and who is not an officer of or employed by the Metropolitan Government, is hereby elected a director of the Industrial Development Board of the Metropolitan Government of Nashville and Davidson County for a term of six (6) years ending August 23, 2007; provided, however, that if at the expiration of said term of office of Grace Fairbanks a successor thereto shall not have been elected, then such person whose term has so expired shall nevertheless continue to hold office until a successor shall be so elected.

SECTION 2. Aubrey Gregory, who is an elector of and taxpayer in the Metropolitan Government of Nashville and Davidson County and who is not an officer of or employed by the Metropolitan Government, is hereby elected a director of the Industrial Development Board of the Metropolitan Government of Nashville and Davidson County for a term of six (6) years ending August 23, 2007; provided, however, that if at the expiration of said term of office of Aubrey Gregory a successor thereto shall not have been elected, then such person whose term has so expired shall nevertheless continue to hold office until a successor shall be so elected.

SECTION 3. Hal Rosson, who is an elector of and taxpayer in the Metropolitan Government of Nashville and Davidson County and who is not an officer of or employed by the Metropolitan Government, is hereby elected a director of the Industrial Development Board of the Metropolitan Government of Nashville and Davidson County for a term of six (6) years ending August 23, 2007; provided, however, that if at the expiration of said term of office of Hal Rosson a successor thereto shall not have been elected, then such person whose term has so expired shall nevertheless continue to hold office until a successor shall be so elected.

SECTION 4. All Resolutions, or parts thereof, in conflict with the provisions of this Resolution are, to the extent of such conflict, hereby repealed.

SECTION 5. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
