RESOLUTION NO. RS2001-861

A resolution authorizing the Department of Law to compromise and settle the lawsuit of James R. Hillin and Nancy Hillin against Twana Chick and William McKay in the amount of $15,000.

Whereas, plaintiffs James R. Hillin and Nancy Hillin are husband and wife who reside in Davidson County, Tennessee; and

Whereas, Mr. Hillin owns multi-family residential real estate that he leases to individuals as apartments, including two complexes located on Clifton Avenue and Jo Johnston Avenue; and

Whereas, these properties were damaged during by the tornado on April 16, 1998; and

Whereas, Mr. Hillin was subsequently arrested by officers of the Metropolitan Nashville Police Department, including Sgt. Twana Chick and Officer William McKay, for criminal endangerment of the tenants; and

Whereas, after the arrest, Mr. Hillin was released and the charges against him were dismissed; and

Whereas, Mr. and Mrs. Hillin filed suit against the Metropolitan Government and Sgt. Chick and Officer McKay.

Now therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the Metropolitan Department of Law is authorized to compromise and settle the lawsuit of Mr. and Mrs. James R. and Nancy Hillin in the amount of ($15,000.00) and that said amounts should be paid from the Judgments and Losses Fund.

Section 2: This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
