RESOLUTION NO. RS2001-859

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of BellSouth Telecommunications against The Metropolitan Government of Nashville and Davidson County in the amount of $45,821 and directing that this amount should be paid from the Self-Insured Liability Fund.

Whereas, on April 10, 2001, a crew of The Metropolitan Government of Nashville and Davidson County Water Services Department, struck Bellsouth's underground cable while digging to repair a broken 6-inch cast iron main which caused damage to claimant's property; and

Whereas, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid for the Self-Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of BellSouth Telecommunications in the amount of $45,821, and that said amount should be paid from the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
