RESOLUTION NO. RS2001-857

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Billy Trogdon against The Metropolitan Government of Nashville and Davidson County in the amount of $6,500, and directing that this amount be paid from the Self Insured Liability Account.

Whereas, on July 18, 2000, while plaintiff was merging onto Church Street in the vicinity of the I-40 off-ramp, the side of plaintiff's 1990 Cadillac DeVille collided with the side of a vehicle owned by the Metropolitan Government and being driven by Metropolitan Employee Chaichana Rungsakui; and

Whereas, a lawsuit was filed by plaintiff in the First Circuit Court for Davidson County, Tennessee; and

Whereas, after investigation, the Department of Law believes the settlement amount as set forth in Section 1 is fair and reasonable and recommends that this case be compromised and settled and that the amount of $6,500.00 be paid from the Self Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Department of Law is authorized to compromise and settle the lawsuit of Billy Trogdon v. Metropolitan Government, No. 00C-3232 for the sum of $6,500, and directing that this amount be paid from the Self Insured Liability Account.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
